Dear Ohio Nurses,
If you are working as an independent provider as a RN or LPN in home care where you directly bill the State of Ohio for the care provided in the Ohio Home Care Waiver Program, listen up. You must, there are no exceptions, submit accurate and correct billing for the care and services ACTUALLY provided.
Do not inflate your billings because at some point you will be audited and contacted by the Ohio Attorney General's office. These are very serious accusations!!!!
Allegations of overbilling the State may have criminal, license, regulatory, employment, and career implications for nurses. Also there are ethical, legal, and professional guidelines imposed by the Ohio Dept. of Jobs & Family Services in addition to the Ohio Nurse Practice Act and Nursing Board regulations (regulating conduct for all nurses) for indepenent providers and those exist for a reason.
I am seeing more cases in the last 4 years with RN and LPN Independent Providers in the State of Ohio and allegations of fraudulent billing and theft related to medicaid billing. These cases can get very complicated quickly and evolve into a legal nightmare for the nurses involved.
If you are being investigated by the Ohio Attorney General's office for these allegations, you need to speak with an attorney ASAP.
